User Agreement
This User Agreement ("Agreement") is a legal contract between you and Beijing Talent Technology Co., Ltd. ("we", "us", or "our") governing your access to and use of the Work in China portal (the "Service"), including job listings, policy information, activities, publications, account features, and related content or tools. Please read this Agreement carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, you must not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.
2. Eligibility
You must be at least 16 years old and have the legal capacity to enter into this Agreement. The Service is intended to provide information and tools related to careers, talent policies, activities, and living and working in China for international users. You are responsible for ensuring that your use of the Service complies with applicable laws in your jurisdiction and in China.
3. Account Registration and Security
If you create an account, you agree to:
- Provide accurate, current, and complete registration information;
- Maintain and promptly update your account information;
- Keep your login credentials confidential and not share them with others;
- Notify us promptly of any unauthorized use of your account.
You are responsible for all activities that occur under your account. We may suspend or terminate accounts that contain false information or are used in violation of this Agreement.
4. Description of the Service
The Service may include, without limitation:
- Job search, listing, and related recruitment information;
- Policy articles and talent-related guidance;
- Activities, events, and program information;
- Publications, magazines, and discovery content;
- Search, browsing, login, and other portal features.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that any job posting, policy summary, activity, or publication will remain available or that any opportunity will result in employment or participation.
5. User Conduct
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Submit false, misleading, defamatory, obscene, or infringing content;
- Attempt to gain unauthorized access to the Service, other accounts, or related systems;
- Interfere with or disrupt the Service, including through automated scraping, bots, or excessive requests;
- Reverse engineer, decompile, or attempt to extract source code except as permitted by law;
- Collect personal information of other users without authorization;
- Use the Service to send spam, malware, or unsolicited communications.
We may investigate violations and cooperate with law enforcement or regulatory authorities as required.
6. User Content and Submissions
If you submit content through the Service, including résumés, applications, messages, or feedback, you represent that you have the right to provide such content and that it does not violate any law or third-party rights. You grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process your submissions solely for operating, improving, and providing the Service, subject to our Privacy Policy.
7. Intellectual Property
The Service, including its design, text, graphics, logos, software, and compilation of content, is owned by us or our licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent. Third-party names, logos, and content remain the property of their respective owners.
8. Third-Party Links and Services
The Service may contain links to third-party websites, employers, event organizers, or other external resources. We do not control and are not responsible for third-party content, policies, or practices. Your interactions with third parties are solely between you and the third party.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Service is complete, accurate, or current.
Job listings, policy summaries, activity details, and publications are provided for informational purposes only and do not constitute legal, immigration, tax, employment, or professional advice.
10. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
To the extent liability cannot be excluded, our total aggregate liability for any claim arising out of or relating to the Service or this Agreement will not exceed the greater of (a) the amount you paid us, if any, for use of the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).
11. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your submissions, or your violation of this Agreement or applicable law.
12. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated this Agreement or if necessary to protect the Service, users, or our rights. Upon termination, provisions that by their nature should survive will remain in effect, including intellectual property, disclaimers, limitation of liability, and indemnification.
13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the People's Republic of China, without regard to conflict of law principles. Any dispute arising out of or relating to this Agreement or the Service shall be submitted to the competent people's court in Beijing, unless mandatory law requires otherwise.
14. Changes to This Agreement
We may revise this Agreement from time to time. The updated version will be posted on this page with a revised "Last updated" date. Material changes may be communicated through the Service or other reasonable means. Your continued use of the Service after the effective date of the revised Agreement constitutes your acceptance of the changes, unless otherwise required by law.
